Clean Air Zone Compelling Reasons Cancellation Request

FOR A CLEAN AIR ZONE PENALTY OUTSIDE LONDON: Birmingham, Bristol, Bath, Sheffield, Bradford, Tyneside, Portsmouth and other charging zones made under the Transport Act 2000.

DO NOT USE FOR A LONDON ULEZ OR CONGESTION CHARGE PENALTY. Different Act, different Regulations, and the statutory test this letter relies on does not exist there.

THIS LETTER IS NOT PLEADING ONE OF THE SEVEN GROUNDS. It asks the authority to apply a separate test that sits alongside them: that there are compelling reasons why, in the particular circumstances of your case, the penalty should be cancelled.

That is a real test written into the Regulations, not a plea for sympathy. If the authority accepts there are compelling reasons, it MUST cancel, and it must refund anything you have paid.

USE IT WHEN: you have no clear statutory ground, or you have one but it is evidentially thin, and there is something genuinely unusual about your circumstances.

YOU CAN USE IT ALONGSIDE A GROUND. If you have a ground, plead the ground first and put this second, clearly marked as an alternative. Never lead with this, because leading with it tells the reader you do not believe your own ground.
