For charges issued on land regulated by byelaws, such as airports, ports and ferry terminals, where POFA 2012 Schedule 4 does not apply, so the operator cannot transfer liability from the driver to the registered keeper. Not for National Rail station car parks: since 26 December 2025 Schedule 4 applies there. Secondary ground: no valid contract formed. Tertiary ground: no landowner authority proved.

rather than by the standard private parking framework.

NOT FOR NATIONAL RAIL STATION CAR PARKS. The law changed on 26 December

2025. The Protection of Freedoms Act 2012 (Definition of Relevant Land)

(Amendment) Order 2025 (SI 2025/1256) removed the railway byelaws made

by the Strategic Rail Authority from the definition, so POFA Schedule 4

DOES now apply at National Rail stations and keeper liability CAN be

transferred there. Use the standard private parking letters instead.

If unsure whether the land is byelaw-regulated, check whether the charge

notice refers to "byelaws", and check the published byelaws for the

airport or port named on the notice.
