ULEZ Disabled Tax Class Grace Period Challenge

For a ULEZ PCN where the vehicle is registered with the DVLA in the disabled or disabled passenger vehicle tax class, which carries a grace period to 24 October 2027. Pleaded on regulation 13(3)(c). Opens by making you check the V5C, because the entitlement attaches to the vehicle's tax class and NOT to receiving PIP, DLA or Attendance Allowance. That is the most common and most expensive misunderstanding about ULEZ and several websites state it wrongly.

DO NOT USE FOR: a Clean Air Zone outside London (Birmingham, Bristol, Bath, Sheffield, Bradford, Tyneside, Portsmouth). Those run on the Transport Act 2000 and SI 2013/1783, the grounds are different, and the appeal goes to the Traffic Penalty Tribunal, not to London Tribunals. Also not for council PCNs, red routes, bus lanes or private parking charges.

The grace period attaches to the VEHICLE'S DVLA TAX CLASS, not to you and not to your benefit.

It applies where the vehicle is registered with the DVLA in the "disabled" or "disabled passenger vehicle" tax class. Look at your V5C and find the taxation class. If it says one of those, you are on solid ground.

RECEIVING PIP, DLA, ATTENDANCE ALLOWANCE OR ANY OTHER DISABILITY BENEFIT DOES NOT BY ITSELF EXEMPT A VEHICLE. This is the most common and most expensive misunderstanding about ULEZ, and several websites state it wrongly. If your vehicle is not in one of those tax classes, this letter will be checked and it will fail.

There are separate arrangements for some wheelchair accessible vehicles and for certain disabled benefit recipients, each with its own registration requirements. If you think one of those applies, check the requirements before relying on it rather than assuming it is automatic.
