ULEZ Statutory Declaration: Enforcement Stage

For a ULEZ penalty that has reached a county court order after a charge certificate. This is the statutory declaration route under regulation 19, available on three grounds only: you did not receive the PCN, you made representations and received no rejection, or you appealed and received no response. Time limit 21 days from service of notice of the order. Carries a prominent warning that a false declaration is a criminal offence, and explains that success on the first ground revokes the order and cancels the charge certificate but allows TfL to serve a fresh PCN, which is your chance to make representations properly.

This is NOT an appeal and it is NOT a representation. It is a formal legal statement made on oath or affirmation.

A STATUTORY DECLARATION THAT YOU KNOW TO BE FALSE IS A CRIMINAL OFFENCE. Do not make one because you disagree with the penalty, because you think the charge is unfair, or because you missed the deadline and want another go. Those are not the grounds and this is not the route.

WHEN THIS APPLIES. Only after a county court order has been made against you following a charge certificate. You will have received notice of the order, normally from the Traffic Enforcement Centre.

THE THREE GROUNDS, AND ONLY THESE THREE:

(a) you did not receive the Penalty Charge Notice

(b) you made representations to TfL and received no notice of rejection

THE TIME LIMIT: 21 days from the date you were served with notice of the county court order.

WHAT HAPPENS IF IT IS ACCEPTED. The court order is deemed revoked and the charge certificate is deemed cancelled. On ground (a), TfL may then serve a fresh Penalty Charge Notice, so this buys you the chance to make your representations properly, not automatic cancellation. On grounds (b) and (c), the case is referred to an adjudicator for directions.

HOW TO MAKE IT. A statutory declaration must be signed in front of a solicitor, a commissioner for oaths, or a magistrate. Many solicitors charge a small fixed fee. Do not sign it at home.
